CHATFINDER.COM (CF) TERMS OF SERVICE (TOS)

Welcome and thank you for visiting ChatFinder.com. By using the ChatFinder Web site and services, you agree to be bound by these Terms of Services (this "Agreement"), whether you register as an Elite or Basic member ("Member").
If you register on the ChatFinder.com service (the "Service"), read these Terms of Service and indicate that you agree to these terms by following the instructions when you sign up for membership. Also, by registering for membership, you agree to transact electronically with ChatFinder.com.
CF does not moderate or influence communication between individuals. Please be courteous and considerate in your chats with other CF members. You are responsible for all activity on your account. You agree to comply with all applicable laws, rules and regulations regarding your use of ChatFinder.com. You agree to comply with all rules and guidelines on the service. CF may take any action against you and your account, ranging from a warning to termination, if you or anyone using your account violates these terms or any other guidelines or policies of ChatFinder.com. CF is not required to provide notice prior to terminating your account.
Your member "profile" is the area of your account data where you may freely describe yourself and your interests subject to the TOS. Your "account data" includes all information supplied to CF.
Basic Membership is free. Elite Services is a paid premium service that will vary in content from time to time.
The member agrees that a violation of any of the following rules may result in a termination of the member account.
1) The member agrees to use this service as permitted by applicable international, federal, state and local laws.
2) A visitor to the site must be registered and subscribed to Elite Services to obtain member screennames. Browsing by non-members is encouraged but screennames will not be displayed.
3) You must be at least 18 years of age and legally able to enter into contracts in order to use the ChatFinder.com Web site or to register for membership. You must register in your own name and provide true and current information. ChatFinder.com will open an account for you once you have successfully completed registration. By registering, you represent that you are at least 18 years of age.
4) The member may not offer for sale, exchange, or purchase a product or service of any nature in the account data, member profile, or elsewhere on the CF site.
5) Membership is limited to individuals and couples. Companies, organizations, and groups may not be members.
6) The member profile may not include any direct contact information including, but not limited to, URLs, homepages, email addresses, phone numbers, and postal addresses. Your last name is never displayed to avoid attempts at unwanted direct contact.
7) Invalid names and/or locations entered in the registration and confirmation process may cause a temporary suspension of services to the member. CF may request proof of identity before resuming services.
8) Profile photographs must be clear, inoffensive, unobscured head and shoulders snapshots delivered preferably in JPEG format. CF will crop to size. All photographs are reviewed and approved before appearing on ChatFinder. We reserve the right to reject, alter, or edit any submitted photograph at our sole discretion without notification to the member. Members may delete or replace their photos at any time from their personal control panel.
9) The member profile may not impersonate or represent any person or entity in an attempt to deceive, harass or otherwise mislead another member. The member shall not supply any false or misleading information in the account data or profile.
10) A member profile or Elite Services message may not contain or facilitate the transfer of software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
11) A member profile or Elite Services message may not promote or incite illegal activity, such as instructional information on how to build a bomb and/or make counterfeit money.
12) A member profile or Elite Services message may not contain material that defames, abuses, threatens, promotes, or instigates physical harm or death to others, or oneself.
13) The member may not harass or be a nuisance to any other member.
14) The member may not use profane, vulgar, racist, or other offensive or inappropriate language in his / her profile. Filters are applied by CF until the offending member or profile can be removed. Solicitation of any form of sexual activity within the member profile or account is prohibited. Propriety is at the sole discretion of CF.
15) The member shall not share the account with another person or allow another person to use the account for any purpose.
16) The member may not infringe on anyone else's intellectual property rights, including, but not limited to, any copyright, trademark, rights of publicity, rights of privacy, or other proprietary rights.
17) The member shall not attempt to harvest or collect member information, including screen names for the purpose of delivering unauthorized or unsolicited advertising, junk or bulk e-mail (also known as "Spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
18) Members may be terminated at the sole discretion of CF any time. No remedy or appeal is available. Elite Services fees are refundable at the sole discretion of CF.
19) All CF services are provided on a best efforts basis and reasonable periodic interruptions common to internet services should be anticipated.
20) Screennames deemed inappropriate, unsuitable, or offensive at the sole discretion of CF will result in suspended member privileges until a new screenname can be substituted by the member.
21) ChatFinder may select certain members to be featured members at its sole discretion. A request from a member to be removed from the featured members list will be honored by CF immediately. Submitted photos become the property of CF and may be used for promotional purposes without notice or compensation to the member. A request from a member to be removed from a promotional display will be honored by CF immediately.
22) You agree to keep confidential the passwords associated with your account. You agree to indemnify and hold harmless CF and IndexCOR LLC for losses incurred by CF or another party due to someone else using your account or password as a result of your failure to use reasonable care to keep your account information confidential. You are responsible for any materials you post or make available on or through ChatFinder.com, including message board posts, chat participation, personal profiles and member profiles. Additionally, you alone are responsible for the consequences of any content you post or otherwise make available on or through ChatFinder.com.
23) Membership in CF is open to all persons complying with the Terms of Service without regard to race, creed, sexual preference, country of origin, or gender.
Billing and Fees
The following terms apply if you have joined as an Elite Member and are subject to a membership fee. All membership fees are due in advance. All membership fees are nonrefundable unless provided otherwise in your subscription plan. Your subscription will be automatically renewed and your payment method will be charged on a monthly or other specified basis, depending upon the advertised terms for your account, and your subscription will continue unless your membership is cancelled or terminated.
Any trial promotion (such as free trial time) must be used within the specified time of the trial. You must cancel your account before the end of the trial period to avoid being charged a membership fee. Please note, however, that even during any free trial or other promotion, you will still be responsible for any purchases and surcharges incurred using your account and that you remain responsible for an telecommunications charges or internet access charges that you may incur while you use ChatFinder.com.
You must select a payment method to pay for your fees for Elite Services and for all purchases made from ChatFinder.com. You must give CF accurate billing and payment information and keep this information up-to-date through your "Control Panel" area on ChatFinder.com. You agree to pay CF for all charges incurred under your account, including all applicable taxes, fees and surcharges. You authorize CF to charge your designated payment method for these charges. If CF does not receive payment from your designated payment method, you agree to pay all amounts due upon demand by CF or its operators.
Every time you use ChatFinder.com, you reaffirm that (i) CF is authorized to charge your designated payment method; (ii) CF may submit charges incurred under your account for payment; and (iii) you will be responsible for such charges, even if your membership is canceled or terminated.
You are responsible for all charges incurred under your account, including applicable taxes, fees, surcharges and purchases made by you or anyone on your account.
You must notify ChatFinder.com's Member Services about any billing problems or discrepancies within 90 days after they first appear on your Account statement. If you do not bring them to ChatFinder.com's attention within 90 days, you agree that you waive your right to dispute such problems or discrepancies.
Telecommunications Charges
You are responsible for obtaining and maintaining at your expense all equipment and services needed to access CF. For example, if you are using a dial-up access service, you are responsible for any telephone charges you may incur by accessing CF. You are also responsible for any communications charges you may incur by accessing CF through other communication networks, such as a cable or wireless carrier.
Procedure for Making Claim of Copyright Infringement
If you believe that your work has been copied and is accessible on this site in a way that constitutes copyright infringement, please notify CF at support@chatfinder.com.
DISCLAIMER OF WARRANTIES
YOUR USE OF CF IS AT YOUR SOLE RISK. CF IS PROVIDED "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. SPECIFICALLY, CF DISCLAIMS IMPLIED WARRANTIES THAT CF SERVICES ARE MERCHANTABLE, OF SATISFACTORY QUALITY, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, OR NON-INFRINGING. CF DOES NOT WARRANT THAT CF SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED, ACCESSIBLE AT ALL TIMES OR ERROR-FREE, OR THAT DEFECTS IN THE SERVICE WILL BE CORRECTED. CF DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE RESULTS OF YOU USE OF CF.
LIMITATION OF LIABILITY
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH YOUR USE OF OR MEMBERSHIP WITH CF IS THE CANCELLATION OF YOUR ACCOUNT AND TO DISCONTINUE YOUR USE OF THE SERVICES. IN NO EVENT SHALL CF'S CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO YOUR USE OF CF SERVICES EXCEED THE TOTAL AMOUNT OF MEMBERSHIP FEES THAT YOU PAID DURING A ONE-YEAR PERIOD.
